It does need to stay upright, because it leaks if you drop it on its side, or at least the one I have suffers from that issue. This thing is exactly what the doctor ordered! The lockable flip top without that stupid straw thingy is weirdly hard to find anymore! Most have a screw top which impedes single handed use. Also, I love the sleek hanging handle- fantastic for a carabineer or lanyard. I hunted high& low for one of these to fit my Hyundai's cupholder( which I think is about 1/4 '' less than industry standard, oddly?) and this thing is an absolute unit of perfection. This works exactly as advertised. My drinks stay cold and I do n't lose carbonation, all day. It does need to stay upright, because it leaks if you drop it on its side, or at least the one I have suffers from that issue.
